Council Member Mamdani Pushes for Simpler Outdoor Dining Rules as Summer Heats Up

On Tuesday afternoon in Astoria, Council Member Zohran Mamdani stood outside a row of cafes on Ditmars Boulevard, speaking with restaurant owners about the city’s outdoor dining program. Many described the same frustrations: permits that take months to process, high fees, and a maze of paperwork.

Since the city moved away from its emergency outdoor dining rules after the pandemic, owners have faced a stricter application process. The current requirements include design standards, limited operating months, and new costs for sidewalk and roadway seating. Restaurateurs say the seasonal structure—outdoor setups must be removed in late fall—adds expense and uncertainty.

Mamdani is calling for City Council to revisit these rules. His proposal, which he outlined in a letter to his colleagues this week, would reduce permit fees and streamline the application. He told NYC Restaurant Voice that many small businesses are deciding not to offer outdoor seating this summer because of red tape. “We see empty curb lanes where there should be tables,” he said.

Some residents have voiced concerns about sidewalk congestion and late-night noise. But on Wednesday morning in Jackson Heights, only a handful of sidewalk cafes were open before noon, and pedestrian flow was largely unaffected. Restaurant owners say the majority of complaints come from a few blocks with denser setups.

City Council is expected to revisit the issue later this summer. For now, many restaurant operators are watching to see if rules will change before the end of the busy season.
